The EU Green Deal & Fora for Climate Dispute Resolution

The European Dispute Resolution is pleased to announce its first event on 6 June 2024 on climate dispute resolution in the context of the EU Green Deal.
The European Green Deal that was launched by the European Commission in 2019 is a package of policy initiatives that aims to set the EU on the path of a comprehensive ‘green’ transition of its society and industry with the ambitious goal of reaching climate neutrality by 2050.
With the ‘Fit for 55 package’, the EU and its member states committed to cutting net greenhouse gas emissions in the EU by at least 55% by 2030, compared to 1990 levels.
What about Dispute Resolution in this domain? Enshrining climate ambitions and sustainable development goals into legislative frameworks potentially transforms environmental concerns and government actions into actually justiciable matter. Who can represent such causes and in what national, European or international courts or tribunals?
The panel will discuss topical procedural and substantive issues relating to the choice of forum for climate litigation since the EU Green Deal policy based on the lessons learned from past cases in the WTO and EU Courts.
This is a very timely topic discussing the increasing prevalence of litigation based on climate, environmental and sustainable development goals such as in the WTO (WTO palm oil settlement case; WTO shrimp-turtle case; WTO tuna-dolphin case; WTO gas guzzler tax on automobiles case), the European Court of Human Rights on climate, pending cases at the CJEU.
